Terms of Service
The rules that keep Hits Surf fair, transparent, secure, and useful.
1. Acceptance of These Terms
These Terms of Service (the “Terms”) govern your access to and use of Hits Surf, including its website, traffic exchange, offers, rewards, premium features, account tools, and related services (collectively, the “Service”).
By creating an account, accessing the Service, purchasing a product, submitting a website or offer, or otherwise using the Service, you agree to these Terms and any policies referenced in them. If you do not agree, do not use the Service.
If you use the Service for a company, organization, or other legal entity, you represent that you have authority to bind that entity to these Terms.
2. Eligibility and Accounts
You must be at least 18 years old and legally capable of entering into a binding agreement to use the Service. The Service is not directed to children.
- You may maintain only the number of accounts expressly permitted by Hits Surf.
- You must provide accurate, current information and keep it updated.
- You are responsible for safeguarding your password and for activity performed through your account.
- You may not sell, rent, transfer, share, or trade an account without our written permission.
- You must promptly contact us if you suspect unauthorized account access.
We may require reasonable identity, payment, ownership, or fraud-prevention verification before granting access to features, processing redemptions, or restoring an account.
3. How the Traffic Exchange Works
Hits Surf allows members to earn or obtain virtual points and use those points to receive visits to submitted websites. A visit may be recorded only after the applicable timer, verification, and completion requirements are satisfied.
- Traffic is provided by members or other sources using the Service. We do not guarantee unique visitors, conversions, sales, search rankings, engagement, or any particular business result.
- You must not represent traffic-exchange visits as organic, editorial, search-engine, or independently generated traffic.
- Automated browsing, bots, click farms, hidden frames, auto-refresh tools, timer bypasses, emulators, scripts, or other methods intended to create false visits or rewards are prohibited unless a feature is expressly authorized by us in writing.
- You may not interfere with timers, completion checks, CAPTCHA systems, security controls, statistics, point calculations, or visit attribution.
Statistics are provided for operational convenience and may be delayed, filtered, corrected, deduplicated, or adjusted to address fraud, technical errors, invalid traffic, or reporting differences.
4. Submitted Websites and Advertising Content
You are solely responsible for every website, landing page, advertisement, banner, offer, message, claim, product, and destination you submit or promote through the Service.
Submitted destinations must load reliably and must not:
- contain malware, spyware, ransomware, cryptominers, malicious code, deceptive downloads, phishing, credential theft, or technical exploits;
- use frame breakers, forced redirects, pop-under or pop-up loops, browser lockers, notification traps, excessive alerts, or mechanisms that prevent a member from returning to Hits Surf;
- promote unlawful activity, fraud, scams, counterfeit goods, stolen property, unauthorized financial schemes, or misleading earnings claims;
- contain sexual exploitation, non-consensual intimate content, content involving minors, graphic violence, credible threats, targeted harassment, or hateful conduct;
- infringe intellectual property, privacy, publicity, or other rights;
- impersonate another person or organization, misrepresent affiliation, or conceal the material terms of an offer;
- require an undisclosed payment, subscription, installation, or sensitive-data submission merely to complete a surf visit;
- generate artificial ad impressions, clicks, affiliate events, reviews, votes, follows, or other actions in violation of a third party’s rules;
- violate any applicable law, regulation, court order, advertising standard, or platform policy.
We may review, reject, pause, remove, limit, or require changes to any submitted content at any time. Approval or continued display does not mean that we endorse the content or confirm its legality.
5. Offers, Tasks, and Incentivized Activity
Offers allow eligible members to create or complete defined tasks in exchange for points or other stated rewards. Offer creators must describe the required action, eligibility conditions, reward, quantity, timer, and material restrictions accurately and clearly.
- An offer may not require illegal, deceptive, fraudulent, abusive, or platform-manipulating activity.
- An offer may not require a positive review, false testimonial, undisclosed endorsement, fake account, misleading engagement, or misrepresentation of genuine consumer experience.
- Where a relationship, reward, or incentive must be disclosed, the creator and participant are each responsible for making a clear and conspicuous disclosure.
- Offer creators must maintain enough points or budget to fund active offers. We may reserve the required amount while an offer is active.
- We may reject or reverse a completion that is duplicate, incomplete, manipulated, unverifiable, fraudulent, or contrary to the offer requirements.
- Unused reserved points may be returned when an offer is canceled or expires, subject to fraud review, chargebacks, processing rules, and any clearly disclosed nonrefundable fees.
Hits Surf is not a party to agreements between members and does not guarantee the quality, legality, performance, delivery, or outcome of an offer.
7. Payments, Billing, and Chargebacks
Prices, fees, taxes, renewal terms, and included features will be presented at or before checkout. You authorize us and our payment providers to process the charges you approve.
- You must use a payment method you are authorized to use.
- You may not initiate a chargeback or payment dispute for a legitimate charge without first contacting us and giving us a reasonable opportunity to investigate.
- Fraudulent payments, unauthorized transactions, payment reversals, or abusive chargebacks may result in suspension, reversal of benefits, recovery of amounts owed, and reporting to payment or fraud-prevention providers.
- Third-party payment processors may impose additional terms and privacy practices.
Unless expressly identified as recurring at checkout, a purchase does not automatically create a subscription.
8. Referral Program
Referral rewards may be offered under the rates and conditions displayed in the Service. You may promote your referral link only through lawful and non-deceptive methods.
- No spam, unsolicited bulk messaging, fake accounts, self-referrals, cookie stuffing, misleading domains, impersonation, or paid-search ads that falsely appear to be official Hits Surf advertising.
- Rewards may be withheld or reversed for duplicate accounts, fraudulent signups, refunded purchases, chargebacks, abuse, or violations of these Terms.
- Referral rates, eligibility rules, thresholds, and availability may change prospectively.
9. Prohibited Conduct
You may not:
- access another person’s account or restricted area without authorization;
- probe, scan, test, bypass, disable, overload, reverse engineer, or interfere with security or operation of the Service;
- scrape, harvest, copy, resell, mirror, or systematically extract Service content or member data without written permission;
- use proxies, VPNs, device farms, multiple identities, disposable accounts, or manipulated device information to evade limits or enforcement;
- submit false reports, fabricate evidence, manipulate statistics, or exploit bugs;
- use the Service to send spam, distribute malware, launder funds, evade sanctions, or facilitate unlawful conduct;
- encourage or help another person violate these Terms.
You must report security vulnerabilities privately to admin@hits.surf and must not exploit, publicly disclose, or retain data obtained through a vulnerability.
10. Monitoring and Enforcement
We may use automated and manual systems to review activity, validate visits, detect abuse, investigate complaints, and protect members and the Service. To the extent permitted by law, we may:
- filter or invalidate traffic, offer completions, rewards, referrals, or transactions;
- remove content or restrict specific features;
- hold redemptions or balances during a reasonable investigation;
- suspend or terminate accounts;
- preserve and disclose information when reasonably necessary to comply with law, enforce these Terms, prevent fraud, or protect rights and safety.
We are not required to monitor every submission or dispute, and our decision not to act in one case does not waive our right to act later.
11. Intellectual Property
The Service, including its software, interface, design, branding, text, graphics, databases, and compilation, is owned by or licensed to Hits Surf and is protected by applicable intellectual-property laws.
You retain ownership of content you submit. You grant Hits Surf a worldwide, non-exclusive, royalty-free license to host, cache, reproduce, display, format, transmit, and otherwise use that content only as reasonably necessary to operate, secure, promote, and improve the Service. This license ends when the content is removed, except for backups, legal records, and uses already authorized.
You represent that you have all rights and permissions needed to submit and promote your content.
12. Copyright and Rights Complaints
If you believe content on the Service infringes your copyright or other rights, send a detailed notice to admin@hits.surf. Include your contact information, identification of the protected work, the specific content or URL at issue, a good-faith statement, a statement that the information is accurate and that you are authorized to act, and your physical or electronic signature.
We may remove or restrict disputed content and may terminate repeat infringers where appropriate.
13. Third-Party Sites and Services
The Service displays and links to websites, ads, products, offers, and services controlled by third parties. Hits Surf does not control or endorse them and is not responsible for their content, security, availability, accuracy, privacy practices, products, transactions, or conduct.
You access third-party destinations at your own risk. Use appropriate browser security, do not provide sensitive information unless you trust the destination, and review the third party’s terms and privacy practices.
14. Service Availability and Changes
We may modify, update, restrict, discontinue, or replace any part of the Service. The Service may experience maintenance, outages, data delays, security incidents, or technical errors. We do not guarantee uninterrupted, error-free, or permanently available operation.
We may establish reasonable limits on accounts, websites, traffic, offers, points, storage, redemptions, or features to protect the Service and its members.
15. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” HITS SURF DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND RESULTS.
We do not warrant that traffic will be unique, human in every instance, commercially valuable, accepted by a third-party analytics provider, or compliant with the rules of every advertising, affiliate, hosting, search, or social platform. You are responsible for determining whether traffic-exchange use is permitted by third parties you work with.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HITS SURF AND ITS OWNERS, OPERATORS, AFFILIATES, LICENSORS, SERVICE PROVIDERS, AND PERSONNEL WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, BUSINESS, TRAFFIC, OPPORTUNITIES, OR EXPECTED SAVINGS.
To the maximum extent permitted by law, the total aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of: (a) the amount you paid directly to Hits Surf during the 12 months before the event giving rise to the claim; or (b) US $100.
These limitations apply regardless of the legal theory and even if a remedy fails of its essential purpose. They do not apply to liability that cannot legally be limited.
17. Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless Hits Surf and its owners, operators, affiliates, service providers, and personnel from claims, liabilities, damages, judgments, losses, and reasonable costs arising from your submitted content, websites, offers, use of the Service, violation of these Terms, violation of law, or infringement of another person’s rights.
This obligation does not apply to the extent a claim results from Hits Surf’s own unlawful conduct.
18. Suspension and Termination
You may stop using the Service at any time. You may request account closure through the available account or support tools.
We may suspend, restrict, or terminate access immediately when reasonably necessary to address fraud, security risk, abuse, legal exposure, nonpayment, chargebacks, prohibited content, repeated complaints, or a material violation of these Terms. In other cases, we may provide notice or an opportunity to cure when practical.
Upon termination, your right to use the Service ends. Points, pending rewards, referrals, and redemptions may be canceled or withheld where connected to fraud, abuse, invalid activity, chargebacks, or a Terms violation. Any treatment required by applicable law will still apply.
Provisions that by their nature should survive termination—including ownership, disclaimers, liability limits, indemnification, disputes, and accrued payment obligations—will survive.
19. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles, except where the law of your residence requires otherwise.
Before filing a formal claim, you and Hits Surf agree to make a good-faith attempt to resolve the dispute by written notice. Send notices to admin@hits.surf with a description of the issue and the requested resolution.
Unless applicable consumer law permits or requires another venue, disputes will be brought in the state or federal courts with jurisdiction in Delaware, and each party consents to those courts.
Nothing in this section prevents either party from seeking urgent injunctive or equitable relief to protect accounts, systems, confidential information, intellectual property, or safety.
20. Changes to These Terms
We may revise these Terms to reflect changes to the Service, law, security practices, or business operations. The updated version will display a revised effective date. When required by law or when changes are material, we may provide additional notice through the Service or by email.
Your continued use after revised Terms become effective constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service.
21. General Terms
- Entire agreement. These Terms and the policies expressly incorporated into them form the entire agreement concerning the Service.
- Severability. If a provision is found unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions will continue in effect.
- No waiver. A failure to enforce a provision is not a waiver.
- Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, financing, reorganization, sale, or transfer of the Service.
- No agency. These Terms do not create an employment, partnership, franchise, joint venture, fiduciary, or agency relationship.
- Headings. Headings are for convenience only.
